Rental Terms & Conditions

Reservations, pickup requirements, payment, returns and responsibility for your rental equipment.

Location: 430 Queen Street, Charlottetown, Prince Edward Island

1.0 Overview

These Rental Terms & Conditions ("Terms") govern the rental of bicycles and related equipment from MacQueen's Bike Shop ("MacQueen's," "we," "us," or "our").

There are three distinct rental pathways under these Terms, and your rights and obligations depend on which one applies to you:

PathwayWho You AreWho PaysWho Signs the WaiverWho Bears Risk of Loss/Damage
A. Direct ClientYou booked directly with MacQueen'sYouYouYou
B. Tour Operator GuestYour rental was arranged and prepaid by a tour operatorYour tour operatorYouYou
C. Third-Party PickupSomeone else is picking up equipment on your behalfYou (prepaid) or your designated person (at pickup)Every adult Rider (parent or guardian for minors), plus the designated pickup personEach Rider, and the designated person for equipment they collect

In all pathways, the individual Rider signs the liability waiver and assumes personal responsibility for loss, theft, or damage to equipment while it is in their care. The difference is in who pays for the rental, how payment is remitted, and how the security deposit is handled.

A liability waiver must be signed and a credit card token provided before equipment is released to any renter.

2.0 Definitions

"Direct Client" — A customer who books and pays for a rental directly with MacQueen's.

"Tour Operator" — A third-party business that books and prepays for rental services on behalf of its clients.

"Tour Operator Guest" — An individual rider whose rental has been arranged and prepaid by a Tour Operator.

"Primary Rider" — The lead rider on a booking, designated by the Tour Operator for Tour Operator bookings. The Primary Rider may designate a third party to collect equipment and provide the credit card token. Each adult Rider signs their own waiver; a parent or legal guardian signs for minors.

"Rider" — The individual who will operate the rented equipment and who signs the liability waiver. In all cases, the Rider assumes personal responsibility for the equipment.

"Designated Person" — A person physically present at the shop to pick up equipment on behalf of a renter.

"Security Deposit" — An amount that may be pre-authorized against a credit card to cover potential late returns, theft, or damage.

"Credit Card Token" — A tokenized representation of a credit card stored securely for the purpose of charging any amounts for which the Rider is responsible under these Terms.

"Party Traveling Together" — A group of renters traveling as a single unit and sharing support resources.

3.0 Reservations & Rental Hours

3.1 Advance Reservations

MacQueen's accepts advance reservations for rental periods of a minimum of three days. Priority for rental equipment is given to multi-day rentals.

Shorter-term rentals (1–2 days) are available on a walk-in basis only, subject to availability.

3.3 Rental Period

The maximum daily rental period is 24 hours from the time of pickup.

Equipment pickups must be arranged during store operating hours.

After-hours returns are permitted at no extra charge when arranged in advance and agreed to by staff.

Example: Pickup at 9:00 a.m., return at 7:00 p.m. (rather than by 9:00 a.m. the next day), with prior staff approval.

After-hours returns must be confirmed in writing prior to the scheduled return. Lock the bike securely at the designated location and call or text a photo to 1 (902) 213-7924.

Lock*

Emergency repair kit*

*We reserve the right to provide one lock per two bikes and to limit emergency repair kit elements to one per party traveling together. Tubes, cartridges, or patches, if used, are payable by the customer. A typical emergency repair kit includes a pump, one tube or patch kit or cartridge, tire irons, and a multi-tool.

4.3 Emergency Road Repair Services

Emergency road repair services are prioritized for MacQueen's Bike Shop tour customers whose packages include in-house support services. Remote service calls are not included with independent rental packages and may not be available even on a paid basis.

If a technician is available, off-site service calls requested by rental clients will be assessed fees based on mileage and hourly wages.

Customers who have engaged only independent rental services (but not MacQueen's tour or support services) may experience delays for remote service calls, depending on staff availability.

4.4 E-Bike Specific Terms

E-bikes require a minimum operator age of 16 years in Prince Edward Island. Renters must follow all battery care and charging instructions provided at pickup. E-bikes must be returned with a minimum battery charge of 10%.

5.0 Third-Party Pickup & Payment

5.1 General Rule

The Primary Rider may designate a third party to collect equipment on their behalf. The person collecting the equipment must be physically present at the shop during outfitting. Before equipment is released, the person collecting it must present a physical credit card for the security guarantee and matching government-issued photo ID at the shop.

If the person picking up the equipment is not the same person who booked the reservation and left the credit card guarantee, the following rules apply.

5.2 Designated Person Requirements

A designated person picking up equipment on behalf of a renter must:

Be physically present in the shop during outfitting;

Present government-issued photo ID that matches the physical credit card presented for the security guarantee;

Present a physical credit card for a swiped transaction; and

Sign a liability waiver accepting responsibility for the equipment they collect.

5.3 Payment Alternatives

If the person paying for the rental is not the same person who booked the service and left the credit card for the reservation guarantee, the renter has two alternatives:

Alternative 1: Prepay in Full Before Pickup

The renter may fully prepay the confirmed rental service by one of the following methods:

E-transfer to bikeshop@macqueens.com; or

Wire transfer to MacQueen's Bike Shop (details available upon confirmation of payment preferences).

When prepayment is received in full, the designated person picking up the equipment is not required to pay for the rental at the shop.

Alternative 2: Designated Third Party Pays at Pickup

The designated third party may pay for the rental in person at the shop on pickup via a swiped transaction with a physical card.

5.4 Security Deposit & Responsibility for Equipment

Before equipment is released, the person collecting it must present a physical credit card for the security guarantee and matching government-issued photo ID at the shop.

There are two possible arrangements:

Arrangement A: Renter Retains Responsibility

If the booking renter (the person who left the reservation guarantee card) will remain the party responsible for the equipment, then:

The booking renter's credit card on file will be tokenized; and

The designated person picking up the equipment must present their own matching government-issued photo ID and physical credit card for verification, and sign a waiver accepting responsibility for the equipment they collect. The security token remains tied to the booking renter's card under this arrangement.

Arrangement B: Third Party Accepts Full Responsibility

If a third party accepts full responsibility for the equipment while under their care, then:

The third party must present their own government-issued photo ID and physical credit card locally at pickup;

The third party's card will be tokenized; and

The third party must sign the liability waiver and will be named as the Rider for the purposes of these Terms, assuming personal responsibility for loss, theft, or damage to the equipment.

If a pre-authorization is applied, it will be processed against the card designated in Arrangement A or B, as applicable.

5.5 Waiver Signature

Every adult Rider must sign their own liability waiver. A parent or legal guardian must sign for each minor. If a designated third party collects equipment on behalf of the booking renter, that person must also sign a waiver accepting responsibility for the equipment they collect.

The booking renter signs their own waiver in advance where possible.

The designated pickup person must sign a waiver even if the booking renter has already signed.

Before equipment is released, the person collecting it must present a physical credit card for the security guarantee and matching government-issued photo ID at the shop.

5.6 Tour Operator Guests

For Tour Operator Guests, the rental is prepaid by the Tour Operator, so Section 5.3 (Payment Alternatives) does not apply. However:

The Rider (or their designated pickup person) must still present government-issued photo ID and a physical credit card for the security token before equipment is released (see Section 6.2.2).

If a third party is picking up on behalf of a Tour Operator Guest, that person must also sign a waiver accepting responsibility for the equipment they collect. The security token is provided according to Section 5.4.

6.0 Payment, Deposits & Security

The payment and deposit process differs depending on whether you are a Direct Client, a Tour Operator Guest, or using a Third-Party Pickup arrangement. All pathways require a signed waiver and a credit card token before equipment is released.

6.1 Direct Clients

6.1.1 Booking & Payment

A personal credit card guarantee is required to process your booking request.

Before equipment is released, the person collecting it must present a physical credit card for the security guarantee and matching government-issued photo ID at the shop.

Payment for confirmed services is processed locally upon delivery of equipment.

Payment for your pre-determined rental period must be paid in full locally, and a waiver signed, before equipment is released into your possession.

If a designated third party will be picking up equipment on your behalf, see Section 5.0.

6.1.2 Security Deposit & Credit Card Token

Your credit card will be stored in a secure vault and tokenized on the day of pickup. Tokenization is not a charge — it simply securely stores your card details so that MacQueen's can process any charges for which you are responsible under these Terms.

MacQueen's reserves the right to pre-authorize a security deposit amount on your credit card prior to releasing equipment. In practice, we rarely pre-authorize; tokenization is usually sufficient. If a pre-authorization is required for your rental, you will be informed at pickup before the pre-authorization is processed.

Where a pre-authorization is applied, the amount is calculated as [retail equipment value + accessories].

The tokenized card may be charged for:

(a) cancellation penalties in the event your booking is cancelled after confirmation; and

(b) late return fees, theft of, or damage to the equipment.

Where a pre-authorization has been applied, authorized amounts may take up to 30 days after departure to be released by your bank or financial institution. MacQueen's is not responsible for any resulting fees or charges.

6.2 Tour Operator Guests

6.2.1 Prepaid Rental

Your rental has been arranged and prepaid by your Tour Operator. You are not required to pay for the rental itself at the shop.

However, you are still required to sign the liability waiver and provide a credit card token before equipment is released.

If requested or available upon outfitting, you are required to pay locally for any equipment upgrades or extras, or for exceeding the stipulated rental period.

6.2.2 Security Deposit & Credit Card Token (Required)

Every Tour Operator booking's Primary Rider (or their designated third party) must leave a credit card token before equipment is released. This applies even though the rental itself has been prepaid. Tokenization is not a charge — it securely stores your card details so that MacQueen's can process any charges for which you are responsible under these Terms.

The tokenized card may be charged for:

(a) late return fees;

(b) theft of, or damage to, the equipment; and

(c) any other charges for which the Rider is responsible under these Terms.

The Primary Rider on each booking accepts personal responsibility for the full retail replacement value of equipment that is lost, stolen, or damaged while in their care.

Where a pre-authorization has been applied, authorized amounts may take up to 30 days after departure to be released by the bank or financial institution. MacQueen's is not responsible for any resulting fees or charges.

See Section 5.0 for rules governing third-party pickup and payment.

6.2.3 No Rental Payment at Shop

Tour Operator Guests will not be asked to pay for the rental itself at the shop. All prepaid rental charges are settled between MacQueen's and the Tour Operator under the separate Tour Operator Addendum (Section 12). Any last-minute upgrades are payable directly by riders.

6.3 Third-Party Pickup

See Section 5.0 for full terms governing third-party pickup, payment alternatives, and security deposit arrangements.

For clarity:

Before equipment is released, the person collecting it must present a physical credit card for the security guarantee and matching government-issued photo ID at the shop.

MacQueen's reserves the right to pre-authorize a security deposit, but in practice rarely does so. If a pre-authorization is required, the designated person will be informed at pickup before it is processed.

If the booking renter retains responsibility (Arrangement A, Section 5.4), the booking renter's card on file will be tokenized.

If a third party accepts full responsibility (Arrangement B, Section 5.4), the third party's card will be tokenized.

6.4 Privacy & Data Retention

Personal and payment information is stored securely and retained only as long as necessary to fulfill the purposes described in these Terms, or as required by law. Credit card data is tokenized and stored in a PCI-compliant vault. For questions about your data, contact info@macqueens.com.

7.0 Liability Waiver & Assumption of Risk

7.1 Waiver Requirement (All Renters)

Every adult Rider must sign their own liability waiver. A parent or legal guardian must sign for each minor. If a designated third party collects equipment on behalf of the booking renter, that person must also sign a waiver accepting responsibility for the equipment they collect. This applies equally to Direct Clients, Tour Operator Guests, and Third-Party Pickup arrangements.

The designated pickup person’s signature is required in addition to each adult Rider’s waiver and the parent or guardian’s signature for each minor. See Section 5.0.

7.2 The Waiver is Between MacQueen's and the Rider

The waiver exists to create a direct legal relationship between the party taking on the risk (the Rider) and the party accepting it (MacQueen's).

MacQueen's owns the equipment and bears the exposure if it is damaged or stolen.

The Rider accepts personal responsibility for loss, theft, or damage to the equipment while it is in their care.

The Tour Operator is not a party to the waiver. A Tour Operator prepays the rental as a commercial arrangement with MacQueen's, but does not accept liability for loss, theft, or damage to equipment while under its guests' care.

7.3 Waiver Identification

The waiver is issued by MacQueen's Bike Shop and is binding between MacQueen's Bike Shop and the Rider. The waiver will at all times identify MacQueen's Bike Shop as the party accepting the risk and the Rider as the party assuming it. A tour operator or third party who only arranged or prepaid the rental is not a party to the waiver and is not responsible for loss, theft, or damage to the equipment. A designated pickup person must sign their own waiver accepting responsibility for the equipment they collect.

7.4 Advance Signature Requirement (Tour Operator Guests)

Tour Operators are required to distribute the online waiver link to their guests in advance of outfitting. The waiver link is:

Open the online waiver ↗

This allows our team to focus on equipment fitting and guest service rather than administrative paperwork.

If a Tour Operator is unable or unwilling to facilitate advance signatures, a $5 + HST per person in-store administrative supplement will be added to the applicable booking. See Section 12.4 for full terms, including who may pay the supplement.

7.5 Assumption of Risk

By signing the waiver, the Rider acknowledges that bicycling involves inherent risks, including but not limited to:

Personal injury or death;

Damage to or loss of personal property;

Equipment failure;

Hazards of the road, trail, or weather conditions.

The Rider voluntarily assumes all such risks.

8.0 Responsibility for Damage or Loss

8.1 All Renters

All renters agree to return the equipment in the same good condition as when received, ordinary wear and tear excepted.

The Rider agrees to repair and replace lost, stolen, damaged, or broken bicycles or parts, or to reimburse MacQueen's for said equipment.

MacQueen's does not offer theft or damage insurance.

In the event equipment is stolen or damaged, the adult Rider or guardian named in the rental contract accepts legal responsibility for reimbursing its full retail replacement value.

Damage assessments will be conducted by MacQueen's staff within 5 business days of return. Renters have the right to obtain an independent estimate at their own expense.

8.2 Direct Clients

The Direct Client is both the payer and the Rider. The credit card on file may be charged for loss or damage as described in Section 6.1.2.

8.3 Tour Operator Guests

The Tour Operator Guest is the Rider. Even though the rental was prepaid by the Tour Operator, the Rider's credit card token (Section 6.2.2) will be charged for loss, theft, or damage. The Tour Operator is not responsible for loss, theft, or damage under this Agreement.

8.4 Third-Party Pickup

If a third party accepts full responsibility for the equipment (Arrangement B, Section 5.4), that third party is named as the Rider and their credit card token will be charged for loss, theft, or damage. If the booking renter retains responsibility (Arrangement A, Section 5.4), the booking renter's card will be charged.

9.0 Cancellation Policy

Cancellation terms differ depending on whether you are a Direct Client or a Tour Operator Guest.

9.1 Direct Clients

Our summer season on Prince Edward Island is short, and cancellations affect our ability to serve other customers. To avoid penalties, we recommend confirming your travel plans before reserving equipment. If you are visiting PEI, consider purchasing cancellation insurance.

9.1.1 Individuals (1–3 bikes per booking)

Notice Given (days before service start)Cancellation Penalty (% of total rental)
31+5%
15–3025% + HST
8–1450% + HST
7 or fewer100% + HST

9.1.2 Groups (4+ bikes per booking)

Notice Given (days before service start)Cancellation Penalty (% of total rental)
31+10% + HST
8–3050% + HST
7 or fewer100% + HST

9.1.3 General Cancellation Terms

Cancellation refers to full or partial cancellation of services.

Credits or refunds are not available for early equipment returns.

Penalties will be applied to your credit card upon confirmation of your written (digital) cancellation request.

HST (Harmonized Sales Tax) is currently 15% in Prince Edward Island.

9.2 Tour Operator Guests

Cancellations for Tour Operator Guests are governed by the separate Tour Operator Addendum (Section 12).

If your Tour Operator cancels your booking, MacQueen's will coordinate with the Tour Operator regarding any applicable penalties.

Individual Tour Operator Guests are not directly responsible for cancellation penalties, which are settled between MacQueen's and the Tour Operator.

9.3 Third-Party Pickup

Cancellations for bookings paid by a third party are governed by the same rules as Direct Clients (Section 9.1), with penalties applied to the credit card on file for the reservation guarantee.

9.4 Weather Policy

Refunds are not provided for weather-related cancellations or illness. We highly recommend contracting travel or cancellation insurance to protect your travel investment against unforeseen circumstances.

If severe weather prevents safe riding, rentals may be rescheduled at no additional cost, subject to availability.

10.0 Late Return Fee (All Renters)

If current availability permits, your ongoing rental can be extended in our system. Confirmed rental extensions are issued an email confirmation by rentals@macqueens.com, for your protection and ours.

If you have not confirmed your rental extension in advance, equipment not returned per the agreed-upon schedule may be reported by MacQueen's as stolen to local authorities.

Since ongoing reservations depend on timely equipment returns, late returns (anytime after the confirmed dropoff time) are subject to a penalty of 1.5 times the regular daily rate, charged per day late.

Example: A rental at $50/day returned 1 day late would incur a $75 penalty ($50 X 1.5).

The same rental at $50/day returned 2 days late would incur a $150 penalty ($50 X 1.5 X 2).

MacQueen's reserves the right to charge the full retail replacement value of equipment not returned within 48 hours of the agreed-upon return time.

For Tour Operator Guests, late return fees will be charged to the Rider's credit card token on file.

For Third-Party Pickup arrangements, late return fees will be charged to the credit card token on file (either the booking renter's or the third party's, depending on the responsibility arrangement).

11.0 Maintenance & Responsibility

Although all of our bikes are professionally serviced between rentals, bicycles may occasionally require tuning during a rental period.

MacQueen's covers routine maintenance of equipment only when delivered at our shop.

MacQueen's industry suppliers are responsible for structural deficiencies such as defective frames, worn bottom brackets, suspension, and wheel hubs.

MacQueen's does not provide free emergency service calls and is not responsible for the following occurrences during bike rental:

Punctures

Broken spokes

Broken chains

Broken derailleurs

Broken drop-outs

Wheel rim damage

Torn saddles

Stripped threads on pedal crank

Damage beyond the control of MacQueen's or the result of rider use, misuse, or abuse

If undertaking an unsupported bicycle trip, we strongly recommend that you have some basic bicycle maintenance knowledge.

12.0 Tour Operator Addendum

This section applies to Tour Operators and their Guests. In the event of a conflict between this Section 12 and the main Terms, this Section 12 prevails for Tour Operator bookings.

12.1 Prepayment & Remittance Advice (The "Zero Guesswork" Rule)

All e-transfers must be notified to info@macqueens.com when actioned and accompanied by a detailed remittance advice (Excel or PDF line-item list) mapping the payment amount to specific confirmation numbers and invoice totals.

If payment is received without allocation, MacQueen's will place it in a pending account and email the Tour Operator for clarification. It will not be applied to aging invoices until the breakdown is received at info@macqueens.com and rentals@macqueens.com.

12.2 Timeline for Upgrades & Adjustments

E-bike upgrades, cancellations, or adjustments made within 30 days of the start date create a short-term receivable.

For upgrades or new reservations within the 30-day window, the Tour Operator must provide evidence of e-transfer payment within 48 hours of written reconfirmation, with payment confirmed in MacQueen's account prior to rental initiation.

A 2% supplement applies to:

Equipment upgrades or new reservations made within 30 days of the scheduled start; and

Payments not received 30 days in advance of the service start date.

The Tour Operator will calculate this supplement on top of the invoiced or upgrade amount.

Example: A $1,000 upgrade made within the 30-day window would incur a $20 supplement (2% of $1,000).

12.3 Invoice Matching & Discrepancy Window

Tour Operators will use Bike.Rent reservation numbers as the primary reference for all payments.

Discrepancy queries must be sent to info@macqueens.com. MacQueen's will dedicate the first week of each month to reconciling the previous month's open questions.

Effective 2027, MacQueen's will not provide manual line-by-line reconciliation of a Tour Operator's ledger against MacQueen's payment history.

12.4 Waivers & Guest Responsibility

Every adult Rider must sign their own liability waiver. A parent or legal guardian must sign for each minor. If a designated third party collects equipment on behalf of the booking renter, that person must also sign a waiver accepting responsibility for the equipment they collect.

The waiver is a contract between MacQueen's and the Rider, not between MacQueen's and the Tour Operator.

Tour Operators are required to distribute the online waiver link to their guests in advance of outfitting.

If for any reason a Tour Operator is unable or unwilling to facilitate the link for their guests to sign digital waivers in advance, a $5 + HST per person in-store administrative supplement will be added to the applicable booking. This amount may be:

(a) prepaid by the Tour Operator; or

(b) paid locally by the guest in-store.

It is the Tour Operator's responsibility to inform their guests of this charge to avoid any last-minute surprises.

12.5 Guest Credit Card Token

The Primary Rider (or their designated third party) from every Tour Operator booking must leave a credit card token before equipment is released, even though the rental itself is prepaid. The Tour Operator will designate the Primary Rider in the Notes when making the booking. If the Tour Operator does not designate a Primary Rider, the first-named guest on the booking will be treated as the Primary Rider.

The token will be used to cover late return fees, theft of, or damage to equipment, and any other charges for which the Rider is responsible under these Terms.

The Tour Operator is not responsible for loss, theft, or damage to equipment under this Agreement.

12.6 Operator Responsibility

Tour Operators and third-party agents must make their clients fully aware of all MacQueen's rental Terms & Conditions when making a booking on their behalf.

12.7 Operator-Specific Terms

Any operator-specific terms (e.g., advance waiver link distribution requirements, in-store waiver supplements, upgrade supplements, or payment reference requirements) will be set out in a separate Operator Addendum signed by both parties and incorporated into these Terms by reference.

13.0 Travel Cancellation & Theft Insurance

MacQueen's does not sell travel cancellation or theft insurance. If interested in acquiring travel or other insurance coverage for rental equipment, we recommend:

Checking whether your homeowners policy offers coverage;

Purchasing coverage locally in your province, state, or country of residence; or

Contacting these insurance companies with local offices in PEI:

Blue Cross® – 1-877-909-7686

The Co-Operators – 1-800-984-0429

14.0 Liability Waiver & Additional Terms

14.1 Waiver Requirement

A liability waiver must be signed and a credit card token provided before equipment is released to the renter.

14.2 Limitation of Liability

MacQueen's Bike Shop assumes no responsibility, however caused, for injury, loss, or damage to person or property in connection with any service resulting directly from the following:

Acts of God

Detention, annoyance, terrorism

Thefts, pilferage

Civil disturbances

Government restrictions or regulations

Strikes

Delays and expenses arising from quarantine

Failure of any means of conveyance to arrive or depart as scheduled

Discrepancies or changes in transit or accommodation services over which we have no control

Other financial loss, whether to persons or property, arising out of certain risks and dangers which may occur during your holiday, including but not limited to the hazards of activities in general

To the fullest extent permitted by applicable law, the rental agent is not responsible for accidents or injuries caused directly or indirectly in the use of the rented item. Nothing in this section limits liability for gross negligence or willful misconduct, or for any liability that cannot be excluded under applicable law.

14.3 Rental Agreement

Our contract is for rental only and not for sale of equipment. The renter agrees that:

He/she will rent the item(s) herein requested;

The item(s) will at all times remain the property of the rental agent named in the rental contract;

He/she will examine the said item(s) upon delivery;

He/she will return them in the same condition as when rented, by the stipulated date and time of return;

He/she will pay all charges for said item promptly when due;

In the event equipment is stolen or damaged, the renter named in the rental contract will be responsible for its retail replacement value; and

The rental agent is hereby released from all claims arising therefrom.

All charges are based on the time the item is in the renter's possession, whether in use or not.

14.4 Age Requirements

Renters must be at least 18 years of age. Minors may rent only with a parent or guardian's signature, and the parent or guardian must accept responsibility for the minor's use of the equipment. Provincial regulations in Prince Edward Island state that e-bikes may only be operated by individuals 16 years of age or older. A parent or guardian may rent an e-bike on behalf of a minor aged 16 or 17, but the parent or guardian remains responsible for the equipment and the minor's use of it.

14.5 Helmet Policy

Helmets are provided with all rentals. Helmets are mandatory in Prince Edward Island. Renters are responsible for ensuring proper fit.

14.6 Route Restrictions

Bikes are not permitted on beaches or in salt water. Riders are responsible for any damage caused by salt water exposure.

14.7 Cleaning Fee

Bikes returned excessively dirty may be subject to a cleaning fee of $20.

14.8 No Subletting

Renters may not lend, sublet, or transfer rented equipment to any other person.

15.0 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be resolved in the courts of Prince Edward Island.

16.0 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.0 Entire Agreement

These Terms, together with the rental contract, the signed waiver, and any applicable Operator Addendum, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements, whether written or oral.

18.0 Amendment

MacQueen's reserves the right to amend these Terms at any time. The version in effect at the time of your rental shall apply.

3. Personal Responsibility for Equipment

I understand and agree that:

The Equipment is my sole responsibility while in my possession.

I accept personal responsibility for any loss, theft, or damage to the Equipment, ordinary wear and tear excepted.

Every adult Rider must sign their own liability waiver. A parent or legal guardian must sign for each minor. If a designated third party collects equipment on behalf of the booking renter, that person must also sign a waiver accepting responsibility for the equipment they collect. Each signer accepts personal responsibility for equipment in their care.

4. Credit Card Token Required

I understand and agree that:

A credit card token is required before Equipment is released.

One credit card token is required per booking. The token must be provided by the Primary Rider (or their designated third party) for that booking, even where multiple Riders are on the same booking.

This requirement applies whether the booking is:

A Direct Client who booked and paid directly with MacQueen's;

A Tour Operator Guest whose rental was arranged and prepaid by a Tour Operator; or

A Third-Party Pickup arrangement.

The tokenized card may be charged for late return fees, theft of, or damage to the Equipment, and any other charges for which the Rider is responsible under the Terms & Conditions.

I understand that the Primary Rider or their designated third party must provide a credit card token for this booking, and that the token may be charged for amounts for which I am responsible under the Terms & Conditions. Before equipment is released, the person collecting it must present a physical credit card for the security guarantee and matching government-issued photo ID at the shop.

5. The Waiver is Between Me and MacQueen's

I understand and agree that:

This Waiver is a contract between me and MacQueen's Bike Shop.

Any Tour Operator or third party who only arranged or prepaid my rental is not a party to this Waiver and is not responsible for loss, theft, or damage to the Equipment. This does not exempt a designated pickup person from signing a waiver and accepting responsibility for the equipment they collect.

The Tour Operator's role is limited to prepaying the rental as a commercial arrangement with MacQueen's Bike Shop. The Tour Operator does not accept liability for the Equipment while it is in my care.

6. Assumption of Risk

I understand and acknowledge that bicycling involves inherent risks, including but not limited to:

Personal injury or death;

Damage to or loss of personal property;

Equipment failure, including mechanical breakdown;

Hazards of the road, trail, or weather conditions;

Collisions with vehicles, pedestrians, animals, or other cyclists;

Terrain hazards, including potholes, gravel, and uneven surfaces;

Risks associated with riding in unfamiliar locations.

I voluntarily assume all such risks, known and unknown, and accept full responsibility for my own safety and the safety of any minors under my care.

7. Release of Liability

To the fullest extent permitted by applicable law, I release, waive, and discharge MacQueen's Bike Shop, its owners, employees, agents, and suppliers from any and all claims, demands, damages, losses, or liabilities arising from my use of the Equipment, including claims for personal injury, death, or property damage.

This release does not apply to claims caused by MacQueen's gross negligence or willful misconduct, or to any liability that cannot be released under applicable law.

8. Indemnification

I agree to indemnify and hold harmless MacQueen's Bike Shop from any claims, damages, losses, or expenses (including legal fees) arising from:

My use of the Equipment;

My breach of this Waiver or the Terms & Conditions;

Any injury or damage caused by me to a third party or their property while using the Equipment.

9. Minors

If I am signing this Waiver on behalf of a minor (under the age of majority in Prince Edward Island):

I confirm that I am the parent or legal guardian of the minor;

I accept personal responsibility for the minor's use of the Equipment;

I accept personal responsibility for any loss, theft, or damage to the Equipment while in the minor's care.

I have been informed that the legal minimum age to operate an e-bike (power-assisted bicycle) on Prince Edward Island is 16 years of age.

10. Governing Law

This Waiver is governed by and construed in accordance with the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein. Any disputes arising under this Waiver shall be resolved in the courts of Prince Edward Island.

11. Severability

If any provision of this Waiver is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

This Waiver, together with the Rental Terms & Conditions and any applicable Operator Addendum, constitutes the entire agreement between me and MacQueen's regarding the subject matter hereof.
